Acceptable Use Policy

1. Status and Incorporation

This AUP forms an integral part of the Snip Studio Terms of Use and End User License Agreement (the “Terms”) and the Snip Studio Privacy Policy. Any breach of this AUP is a material breach of the Terms. A material breach activates, without limitation, the indemnity obligations set out in the Terms and is subject to the limitation of liability, the governing-law and jurisdiction provisions, and the severability rule in the Terms. Where this AUP and the Terms appear to conflict, the Terms control.

2. Acceptance

You accept this AUP by downloading, installing, opening, accessing, purchasing, or using Snip Studio, including any feature unlocked by an in-app purchase or subscription. If you do not accept this AUP, do not use Snip Studio. Continued use after any update means you continue to accept it as updated.

3. Definitions

In this AUP: (a) “User,” “you,” and “your” mean any natural person who uses Snip Studio. (b) “Content” means any screenshot, screen recording, capture, image, annotation, decision, or other material you create or handle using Snip Studio. (c) “Personal Data” has the meaning given in Article 4(1) of the EU GDPR and any equivalent term under other applicable data-protection law. (d) “Misuse” means any use of Snip Studio that violates this AUP, the Terms, the Privacy Policy, Apple’s published platform rules, or any applicable law. (e) “Credible Report” means a good-faith report of suspected Misuse with sufficient detail to enable MAHTCA GLOBAL to identify, evaluate, and consider action. (f) “Authority” means any competent law-enforcement body, court, regulator, data-protection supervisory authority, prosecutor, child-protection hotline, or other public body with lawful jurisdiction. (g) “Apple” means Apple Inc. and its affiliates, including as third-party beneficiary under the Terms.

4. Intended Uses

Snip Studio is intended to support lawful, privacy-respecting, good-faith uses, including capturing and recording your own screen, marking up and refining your captures, hiding sensitive details before you share, and organizing captures you own or have a lawful right to handle. A use is permitted unless it falls within §5 or otherwise violates the Terms, the Privacy Policy, applicable law, or the rights of a third party.

5. Prohibited Conduct

You must not use Snip Studio, and must not permit any other person to use Snip Studio on your behalf, in any way that involves the following. This list is illustrative and not exhaustive.

(a) Child sexual abuse material (CSAM) and child safety violations — absolute zero tolerance. You must not use Snip Studio to capture, record, view, process, conceal, prepare for distribution, distribute, or alter any image or recording that constitutes child sexual abuse material or that sexualises, exploits, or endangers any person under 18. Reference: EU Directive 2011/93/EU; Budapest Convention Article 9; 18 U.S.C. §§ 2251–2258A; Romanian Penal Code Articles 374–375. Such material is reportable to NCMEC and equivalent national hotlines.

(b) Non-consensual intimate imagery (NCII) and image-based sexual abuse. You must not use Snip Studio to capture, record, process, conceal, distribute, or prepare for distribution any intimate image or recording of any person without that person’s free, specific, informed, and unambiguous consent. Reference: EU Directive 2024/1385; UK Online Safety Act 2023 section 66B.

(c) Covert surveillance, stalking, harassment, doxing, and intimidation. You must not use Snip Studio to covertly record or capture another person’s screen, device, communications, or activity, or to identify, locate, monitor, harass, intimidate, or facilitate harm against any person. Reference: EU Directive 2024/1385; Istanbul Convention.

(d) Privacy violations against identifiable third parties. You must not use Snip Studio to capture, record, or process Personal Data of any identifiable third party — for example another person’s messages, calls, accounts, or on-screen information — without a lawful basis under applicable data-protection law, including the EU GDPR, UK GDPR, CCPA/CPRA, LGPD, PIPL, the Indian DPDP Act, the Australian Privacy Principles, and PIPEDA.

(e) Evidence tampering and obstruction of justice. You must not use Snip Studio’s redaction, cropping, or editing tools to destroy, conceal, fabricate, or misrepresent any image, recording, or evidentiary fact in connection with any actual or reasonably foreseeable legal, criminal, regulatory, insurance, employment, audit, or evidentiary proceeding. Reference: Romanian Penal Code Articles 271–273 and equivalent statutes.

(f) Infringement and circumvention of protection measures. You must not use Snip Studio to capture, record, or reproduce content in violation of a third party’s copyright, contract, confidentiality, or technical protection measures, and you must not bypass or facilitate the bypass of any in-app purchase gating, subscription gating, entitlement check, licence verification, or anti-tamper mechanism in Snip Studio. Reference: EU Directive 2001/29/EC Article 6; 17 U.S.C. § 1201 (DMCA).

(g) Reverse engineering, redistribution, or modification, as prohibited by the Terms.

(h) Use in service of any unlawful activity under any law, rule, regulation, court order, sanctions regime, or platform rule applicable to you or to MAHTCA GLOBAL.

The absence of a specific category from this section does not imply it is permitted. Conduct that is unlawful, harmful, deceptive, or that violates the rights of any person is prohibited whether or not enumerated here.

6. What We Can and Cannot Do

Snip Studio operates on your Mac. MAHTCA GLOBAL does not receive, transmit, access, host, or store any Content or telemetry from your use of the application. As a result: (a) MAHTCA GLOBAL cannot detect, monitor, scan, audit, log, or observe your use of Snip Studio; (b) MAHTCA GLOBAL has no technical means to suspend, throttle, restrict, or revoke your access on a running device; (c) MAHTCA GLOBAL has no telemetry or usage record to consult in connection with any Credible Report; (d) MAHTCA GLOBAL may act on Credible Reports as set out in §7 and §8; (e) MAHTCA GLOBAL may refuse to provide support, customer service, goodwill consideration, or future product access to any User who is the subject of a Credible Report indicating Misuse; (f) MAHTCA GLOBAL does not warrant or promise that it will detect, prevent, identify, halt, or remedy any Misuse, and the absence of detection or action is not an endorsement of any conduct and does not waive any provision of this AUP.

7. Cooperation with Authorities and with Apple

MAHTCA GLOBAL will cooperate in good faith with any Authority and with Apple in response to valid legal process directed to MAHTCA GLOBAL; Credible Reports indicating an imminent risk of serious harm; reports of suspected CSAM falling within §5(a), which will be referred to NCMEC and equivalent national hotlines; and requests from Apple in connection with the App Store, the Apple Developer Program, App Store Review, or any Apple enforcement action — in each case subject to applicable law. Because MAHTCA GLOBAL retains no Content or usage record relating to your use of Snip Studio, cooperation is limited to confirming the local-only architecture and the absence of any server-side log; providing technical documentation or affidavits to the extent legally compelled; removing or modifying Snip Studio features at Apple’s request or the lawful direction of any Authority; and any other action required by law.

8. Notice and Action Procedure

Reports of suspected Misuse should be sent to help@snippingstudio.app. To qualify as a Credible Report, a notice should include, to the extent the reporter is able: a clear identification of the person, conduct, or material involved; a description of the alleged Misuse with sufficient detail; contact information where the reporter is willing to be contacted; and a good-faith declaration of accuracy. MAHTCA GLOBAL will acknowledge Credible Reports within a reasonable time, evaluate them in good faith, and take any action it determines, in its sole discretion and consistent with applicable law, to be appropriate, without promising any specific outcome or timeline. MAHTCA GLOBAL may decline to act on, close, or refer to an Authority any report that is frivolous, abusive, manifestly unfounded, repetitive, or made in bad faith. This procedure is modelled on the spirit of Article 16 of EU Regulation 2022/2065 (Digital Services Act) as voluntary good practice and does not constitute an admission that Snip Studio is a hosting or intermediary service.

9. Reporter Safe Harbour

To the maximum extent permitted by applicable law: MAHTCA GLOBAL will treat the identity of a good-faith reporter as confidential, subject to disclosure required by law; will not retaliate against any person for a good-faith report; and will not be liable to any reported User for any claim arising from a good-faith report received from a third party. Reports made in bad faith, knowingly false reports, and reports submitted to harass another User are not protected, may themselves constitute Misuse, may activate the indemnity in the Terms, and may be referred to an Authority.

10. Consequences of Breach

Any breach of this AUP: (a) is a material breach of the Terms; (b) activates your indemnity obligations under the Terms; (c) is subject to the limitation of liability in the Terms, including the disclaimer of indirect, incidental, special, consequential, exemplary, and punitive damages and the aggregate liability cap; (d) forfeits any goodwill consideration on refunds, support, or future product offerings; (e) may be reported to Apple, to any Authority, or to any person identified as having suffered or being at risk of harm. The remedies available to MAHTCA GLOBAL are cumulative and in addition to any other remedy available under the Terms, this AUP, or applicable law.

11. Reservation of Rights

MAHTCA GLOBAL reserves all rights not expressly granted to you in the Terms, the Privacy Policy, or this AUP, including the right to update, modify, or withdraw this AUP (subject to §16); act or decline to act on any report; publish anonymised summaries or warnings about confirmed Misuse patterns; cooperate with Authorities and Apple; refuse support or future product offerings to any User credibly reported to be in breach; and enforce this AUP selectively in light of available evidence, resources, and legal advice, without thereby waiving any other right or remedy. No failure or delay in exercising any right operates as a waiver.

12. No Third-Party Beneficiary Rights (except Apple)

Apple and Apple’s subsidiaries are intended third-party beneficiaries of the Terms and of this AUP, and may enforce this AUP against you. No other person or entity has any right to enforce this AUP against MAHTCA GLOBAL. A third party who suffers harm as a result of your Misuse must pursue you, not MAHTCA GLOBAL, for any remedy. Nothing in this section limits any right of an Authority to bring an action against MAHTCA GLOBAL where MAHTCA GLOBAL has independent legal responsibility.

13. Survival

Your obligations under this AUP, and any indemnity, defence-control, cooperation, or consequence-of-breach obligation arising from your use of Snip Studio while this AUP was in force: survive your deletion or uninstallation of Snip Studio; survive any termination, expiry, refund, or reversal of any in-app purchase or subscription; survive any termination, expiry, or modification of the Terms; and apply to any Content you handled using Snip Studio at any time during which this AUP or any prior version of it was in force.

14. Severability

If any provision of this AUP is found to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law, or modified to achieve the closest lawful effect. The remaining provisions will remain in full force and effect.

15. Governing Law and Forum

This AUP, and any dispute arising out of or in connection with it, are governed by the laws of Romania, without regard to its conflict-of-law principles, and are subject to the non-exclusive jurisdiction of the courts of Dolj County, Romania. Nothing in this section deprives you of the protection of mandatory consumer-protection rules of the country in which you reside. EU consumers may also access the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

16. Changes

MAHTCA GLOBAL may update this AUP from time to time to reflect changes in Snip Studio, applicable law, Apple’s requirements, or its practices. When updated, the Version and Effective Date will change, and the updated AUP will be made available at its published location. Where a change materially affects your rights, MAHTCA GLOBAL will use reasonable efforts to notify you within Snip Studio before it takes effect. If you do not accept an update, your remedy is to stop using and delete Snip Studio.
